General Terms and Conditions

1. Introduction

These Terms and Conditions are issued by Potje Technologie B.V. (KvK 84112905), Alexanderveld 5, 2585DB The Hague, the Netherlands. Group Gift is a concept owned and operated by Potje Technologie B.V.

Use of the platform is conditional on acceptance of these terms. Continued use after updates constitutes acceptance of revised terms.

2. Definitions

• Platform: Group Gift web and/or mobile platform.
• Group Gift: Digital collection for a designated receiver.
• Organiser: User creating and managing a group gift.
• Contributor: User making a monetary contribution.
• Receiver: Designated recipient of collected funds after KYC.
• KYC: Identity verification handled by Online Payment Platform B.V.
• Voluntary Platform Donation: Optional donation by contributors.

3. The Group Gift Service

Group Gift enables users to pool money for shared gifts. Potje Technologie B.V. is not a payment processor and does not hold funds. Financial transactions are handled by Online Payment Platform B.V.

Contribution and payout limits are determined by Online Payment Platform B.V. and may change over time.

4. Roles and Responsibilities

Organiser: responsible for accurate setup, invitations, and payout initiation.

Contributor: contributions are voluntary and generally final once processed.

Receiver: must complete KYC and link a valid SEPA bank account to receive payout.

5. Service model and pricing

Group Gift is free to use. We do not charge any platform fee for creating or receiving a Group Gift payout.

Contributors may optionally leave a voluntary donation to Potje Technologie B.V., separate from the gift amount. This is entirely optional and has no effect on the features or functionality available to you.

6. Identity Verification (KYC)

KYC is mandatory for receivers before payout and is handled by Online Payment Platform B.V. Additional verification may be required based on amount thresholds or compliance rules.

7. Prohibited Use

Prohibited use includes fraud, money laundering, illegal activities, hate/violence promotion, and misleading collections. Potje Technologie B.V. may suspend accounts, cancel suspicious transactions, and report cases to authorities.

8. Pay-Out Process

Once the receiver has completed KYC and connected a bank account, they trigger the payout themselves from their recipient page. The organiser can only cancel a collection that has not yet received any contributions. Processing timelines depend on Online Payment Platform B.V. Partial withdrawals are not supported.

9. Intellectual Property

Platform content and branding are owned by Potje Technologie B.V. or affiliates. Users receive a limited, revocable, non-transferable right to use the platform for intended purposes only.

10. Data Use

User data is processed in accordance with the Group Gift Privacy Statement available on the platform.

11. Liability

Potje Technologie B.V. is not party to agreements between organisers, contributors, and receivers. Liability is limited as described in the Terms and, where applicable, capped at EUR 1,000 for direct damages except in cases of intent or deliberate recklessness.

12. Termination

Users may stop using the platform and delete accounts at any time after leaving or closing active group gifts. Potje Technologie B.V. may terminate access in case of breaches.

13. Miscellaneous

These terms are governed by Dutch law. Disputes are submitted to the competent court in The Hague unless mandatory law provides otherwise.
